In consideration of a Vendor Sale of Fireworks Permit being granted, the applicant and permit holder hereby releases, waives, and forever discharges the City of Richmond Hill and its agents, officials, employees, contractors, representatives, elected and appointed officials of all actions, causes of actions, lawsuits, claims of liability for personal injury, illness, loss of life or property damage of any kind or nature, arising out of or sustained and/or arising out of the acts or omissions directly or indirectly of the applicant and permit holder, it’s directors, officers, employees, agents, contractors, representatives, successors, assignees, and invitees by reasons associated with the permit, including but not limited to, sale, accidental discharge, transport, set-up, operations display and or discharge of fireworks, or any other activity associated or may arise from this permit.
The applicant and permit holder further agree to Indemnify and save harmless the City of Richmond Hill and its agents, officials, employees, contractors representatives, elected and appointed officials, successors and assigns from and against any and all liability by any of them or all of them arising as a result of, or in any way connected with the issuance of a Vendor Sale of Fireworks Permit. This Waiver and Indemnity applies to all claims, foreseen and unforeseen, including negligence and breach of statutory or other duty of care, including that owed under the Occupier’s Liability Act.
I recognize that by submitting this application I am waiving certain legal rights including the right to sue and acknowledging that the information contained in this application is accurate, true and correct.
